WidgetFlair Terms of Service
These Terms of Service (“Terms”) govern your use of the WidgetFlair iOS application and its widgets (the “Service”). “We,” “us” and “our” refer to the operator of WidgetFlair.
By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how information is handled.
1) Eligibility
You must be legally able to agree to these Terms, or have a parent or legal guardian agree where required. You may use the Service only where lawful and available.
2) The Service
WidgetFlair lets you create, customize and save widgets for your Home Screen and compatible Lock Screen placements, including clocks, dates, notes, personal tracking and decorative designs. You can also share images of your designs.
- No WidgetFlair account is required.
- Browsing designs, editing, local saving and using saved widgets work offline. Loading subscription prices, purchases, restoration and some subscription verification require a connection to Apple; iCloud-only photos must first be downloaded.
- Your widget library is stored on your device. WidgetFlair does not provide its own cloud sync or online recovery.
- Widget sizes, appearance and interaction depend on the design, your device and iOS support.
3) Free access and WidgetFlair Premium
WidgetFlair includes free widget designs, identified in the app. All designs can be previewed and personalized before purchase.
WidgetFlair Premium lets you create and customize all Premium widget designs. Monthly and yearly plans provide the same access. New Premium designs made available in app updates can be created and used during an active subscription; no particular release schedule is promised. Each plan’s features, limits, price and billing period are described in the app before purchase and form part of the subscription offer. Changes affecting a paid subscription remain subject to applicable law.
Saved widgets remain usable, editable and interactive after a subscription expires. Saving a new Premium widget requires an active subscription, verified through Apple’s StoreKit. Restored access on another device does not transfer your locally saved widgets. Local storage remains subject to device capacity and the app’s library limits.
4) Subscriptions and payments
Subscriptions are auto-renewing in-app purchases through Apple.
- Apple charges your Apple Account when you confirm a purchase. The purchase screen shows the localized price, billing period and any applicable offer.
- Subscriptions renew automatically unless canceled through Apple. Apple may charge for renewal within 24 hours before the current period ends; cancel before renewal to avoid another charge.
- You can manage or cancel your subscription in your Apple Account subscription settings. Cancellation normally takes effect at the end of the paid period, subject to Apple’s procedures and applicable law.
- Restore purchases checks for an eligible entitlement with Apple; it does not restore your widget library.
- Apple handles billing and refund requests under its policies, without limiting applicable statutory rights. Any trial or offer is governed by the terms shown at purchase.
Deleting the app does not cancel a subscription.
5) Your content
“Your Content” means the photos, text, personal entries and other material you use in the app. You retain any rights you have in Your Content. We do not claim ownership of Your Content. The app processes Your Content locally to provide the features you use.
You must have the rights and permissions needed to use Your Content. You are responsible for ensuring that displaying, saving, sharing or publishing it complies with applicable law and others’ intellectual-property, privacy and other rights. Using WidgetFlair does not clear rights in the underlying material.
6) Acceptable use
You may not use the Service to:
- violate law or another person’s rights, including through fraud, unlawful harassment or exploitation of minors;
- use material you are not authorized to use;
- introduce malware or interfere with the app or related systems; or
- bypass subscriptions or other access controls.
Restrictions on copying or reverse engineering are subject to applicable law and the Apple license described below.
7) Intellectual property
The app, software, included designs and branding belong to the operator of WidgetFlair or its licensors. You may use the included designs in widgets you create and images you share through the Service. This does not transfer ownership of the app’s materials or permit redistributing them as standalone assets.
8) Local storage and third-party services
Deleting the app or its data, device loss, system failure or storage corruption may cause loss of saved widgets and personal records. Keep separate copies of important content. Shared design images do not restore an editable widget library or its activity history.
Your system settings may include app data in an Apple backup or sync exported images through Photos. Apple and sharing destinations you choose have their own terms and privacy practices. We remain responsible for our own legal obligations.
9) Service availability and changes
Features may be affected by device compatibility, storage or Apple service availability. We may update, modify or discontinue the Service, subject to applicable law. Material changes affecting a paid subscription will receive any notice or remedy required by law and Apple’s applicable procedures. Changes to these Terms apply prospectively, with notice or agreement where required by law.
10) Termination
You may stop using the Service at any time. Your license may end for a material breach of these Terms or under the Apple Standard EULA, subject to applicable law.
Ending use or termination does not automatically cancel an Apple subscription; cancel through Apple to stop future renewals.
11) Service expectations and consumer rights
Widget refresh timing is controlled by iOS and may be delayed. Focus and countdown widgets are visual aids and do not sound alarms. Wellbeing widgets provide general lifestyle tools and do not diagnose or treat medical conditions. Playful suggestions and random choices are for entertainment.
To the extent permitted by law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when you agreed to these Terms.
Nothing in these Terms limits any warranty, remedy, consumer right or liability that cannot legally be limited or excluded, including liability for fraud, willful misconduct or death or personal injury where such limitation is prohibited.
12) Apple App Store terms
The license to the app is governed by Apple’s Standard End User License Agreement (EULA). These Terms supplement that license and do not replace it. The Standard EULA governs any conflict concerning the app license, subject to mandatory law.
The Service is provided by the operator of WidgetFlair, not Apple. Apple has no obligation to provide maintenance or support for the app.
13) Governing law and miscellaneous terms
Unless applicable law requires otherwise, these Terms are governed by the laws of the jurisdiction in which the operator of WidgetFlair is established, without regard to conflict-of-law rules. Nothing in these Terms deprives you of mandatory consumer rights or access to courts available where you live.
If any provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver.
